By downloading, installing, or using the HopShops mobile application or website (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
HopShops is a product discovery and search engine platform that enables users to:
- Search for products across public online retailers and storefronts.
- Save and organize product links, wishlists, and collections within the app.
- View product pricing and availability across indexed stores.
HopShops is entirely a search engine. We do not sell products directly, handle commercial inventories, process transactions, or fulfill orders. Purchases are completed directly on the respective external retailers' websites, which open within an in-app browser or WebView environment.
3. Eligibility
You must be at least 13 years of age to use the Service. Users between 13 and 18 must have parental permission.
4. Account Registration
You agree to provide accurate information, maintain account security, and notify us of unauthorized access. You are responsible for all activity under your account.
5. User Conduct
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Upload or transmit malicious code or harmful content.
- Scrape or extract data without written permission.
- Impersonate any person or entity.
- Interfere with the Service's integrity or performance.
6. Intellectual Property
6.1 HopShops Content
The Service and its original content are owned by HopShops, Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or sell any part without written permission.
6.2 User Content
By submitting content to the Service, you grant HopShops a non-exclusive, worldwide, royalty-free license to use it in connection with the Service.
6.3 Third-Party Content
Product information, index rankings, and images are aggregated from third-party retailers via public endpoints. Respective brands retain all rights to their content.
7. Third-Party Links and WebViews
The Service utilizes in-app WebViews to display external retail interfaces. When you interact with or purchase from these third parties, you are leaving the HopShops native software environment and interacting directly with the third-party merchant.
HopShops does not control, operate, review, or assume responsibility for the content, privacy settings, secure checkout systems, or commercial practices of external retail websites. Your interactions are governed solely by those retailers' respective terms.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. HOPSHOPS DISCLAIMS ALL WARRANTIES INCLUDING ACCURACY OF PRODUCT INFORMATION, FITNESS FOR PURPOSE, AND UNINTERRUPTED OPERATION.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOPSHOPS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR AMOUNTS PAID IN THE PAST 12 MONTHS.
10. Indemnification
You agree to indemnify and hold harmless HopShops from claims arising from your use of the Service or violation of these Terms.
11. Modifications
We may modify or discontinue the Service at any time. Continued use after changes constitutes acceptance of the revised Terms.
12. Termination
We may suspend or terminate your account for conduct that violates these Terms. You may terminate your account at any time through app settings.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved in Delaware courts.
